Who provides the service

By installing or using any of the Banot apps you accept these terms. If you do not agree with them, do not use the apps. How we handle data is explained in the app privacy policy, which forms part of this agreement.

What Banot is, plainly

Banot is a measurement system for training: a LiDAR sensor that measures how far away the athlete is many times a second, and apps that turn those measurements into speeds, splits and an analysis. It is for training better and for showing an athlete what they just did.

What you measure is your responsibility

This is the important clause and we do not want it to disappear among the others.

Banot records video of identifiable people and stores measurements against their names. When you use Banot with your athletes, you or your club are the controller of that data, not drimiun. That means it falls to you to:

We provide the tools and will help if you ask. If you need a signed data processing agreement, write to us.

What you may do with the apps

We grant you a personal, non-exclusive, non-transferable and revocable licence to install and use the Banot apps on devices you control, to the extent your plan allows. It is a licence to use: the software remains ours.

If you breach this seriously we may suspend access; we will tell you, and why, unless the law stops us.

Your content stays yours

The videos, measurements, names and reports you produce are yours. We acquire no rights over them and do not use them to train models, to promote ourselves, or for anything other than providing the service to you.

You grant us only the technical permission strictly needed to store, transmit and transform them when you ask us to: converting a video to another format so a browser can play it, generating a PDF, showing it on the scoreboard. That permission ends when you delete the content.

If we ever wanted to use footage of yours to demonstrate the product, we would ask you expressly, and you could say no.

The limits of the measurement

An instrument that does not say where it fails is not a serious instrument, so:

The sensor

The Drimiun Banot sensor is sold separately and comes with its own safety, conformity and usage documentation. Read it before using the device and follow what it says about the laser beam, the battery and operating conditions. These terms cover the software; the device's warranty is the one the law gives you and the one stated in your purchase.

If you buy as a consumer you have the statutory guarantee of conformity, and nothing in this document takes it away from you.

Availability

We do what is reasonable to keep the service running, but we do not promise uninterrupted availability: we depend on Google Cloud, on the app stores and on your connection. We may carry out maintenance and, where it is foreseeable and affects you, tell you about it.

We may change or withdraw features. If we withdraw one you were using that was part of a paid plan, we will give you notice and a reasonable way out.

Liability

We are liable for damage we cause you by breaching this agreement, subject to the following limits, which are the usual ones and which do not apply to wilful misconduct, gross negligence, damage to life or health, or anything the law declares cannot be waived:

If you use Banot as a consumer, these limits apply only as far as consumer law allows, which in Spain is not very far: your consumer rights override this text.

Ending the agreement

You may stop using Banot whenever you like, and delete your account from Settings › Account. Doing so removes what you hold on our servers; what is on your device stays there until you uninstall.

We may end the agreement if you breach these terms seriously or repeatedly, or if we stop providing the service; in that case we will give you enough notice to take your data with you, and refund the unused part of anything you have paid.

Governing law and complaints

Spanish law applies. For any dispute, the courts of Santa Cruz de Tenerife, unless you are a consumer: in that case you may go to the courts of your own domicile, and you keep every right the law of your EU country of residence gives you.

Before that, write to us: most things get sorted by email. If you are a consumer and we do not reach an agreement, you may use the consumer dispute resolution route that applies to you.

Changes to these terms

If they change, we will publish the new version here with its date and tell you inside the app before it takes effect. If a change is to your detriment and you do not accept it, you may stop using the service and we will refund the unused part. The Spanish version governs.
